Marine Loading: Subpart Y Meets Subpart CC

While NESHAP Subpart Y remains the primary regulatory framework for marine vessel loading, the operational boundary between it and refinery-wide compliance under MACT CC, etc. has effectively dissolved. Since MACT CC fenceline monitoring requires measurement for the entire property, emissions originating from marine vessels have the potential to be captured in the measured concentrations, exposing refiners to new enforcement vulnerabilities. Refineries are now being targeted for enforcement for the mechanical failures of MACT Subpart Y via data generated from the Subpart CC Refinery MACT fenceline monitoring requirements.

The EPA has identified marine loading as one of the likely sources for elevated fenceline readings. Specific marine loading operations deficiencies cited include:

  • ๐๐จ๐จ๐ซ ๐‹๐จ๐š๐๐ข๐ง๐  ๐€๐ซ๐ฆ ๐Ž๐ฉ๐ž๐ซ๐š๐ญ๐ข๐จ๐ง: Leaks and drips caused by mechanical failure or operator error.
  • S๐ฅ๐จ๐ฉ ๐–๐š๐ฌ๐ญ๐ž ๐Œ๐ข๐ฌ๐ก๐š๐ง๐๐ฅ๐ข๐ง๐ : Improper disposal of material dripping from loading arms
  • ๐๐จ๐ง-๐•๐š๐ฉ๐จ๐ซ-๐“๐ข๐ ๐ก๐ญ ๐๐š๐ซ๐ ๐ž๐ฌ: Use of vessels that fail to maintain integrity during the loading cycle.
  • ๐๐ซ๐ž๐ฌ๐ฌ๐ฎ๐ซ๐ž ๐‘๐ž๐ฅ๐ข๐ž๐Ÿ ๐•๐š๐ฅ๐ฏ๐ž (๐๐‘๐•) ๐‹๐ข๐Ÿ๐ญ ๐„๐ฏ๐ž๐ง๐ญ๐ฌ: PRVs relieving while a barge is docked, releasing concentrated vapors directly into the path of fenceline samplers.

On March 4, 2026, EPA proposed revisions to NESHAP Subpart Y. Key proposed changes include:
