EPA Opens the Door to Longer Permit Approval Times

In an effort to streamline the Title V petition process, EPA has recently allowed an avenue to stakeholders to potentially delay a permit approval. Stakeholders need only to wait until the end of the review period to submit petitions to reset the EPA 45-day review period. State agencies will be required to respond to “significant” comments in writing to EPA prior to the agencies review process can begin. A pre-publication version of the final rule and a summary fact sheet are available at: https://www.epa.gov/title-v-operating-permits/current-regulations-and-regulatory-actions
